As we continue to navigate the uncharted path of the COVID-19 pandemic and the ongoing efforts to curtail the spread of the virus, we at Gesmonde, Pietrosimone & Sgrignari want to share some important information with you.
We want to assure all of you that we remain open for business. While we are conducting most of our business remotely, we remain available to assist you with your legal needs. Rest assured that we will continue to work on your matters to comply with all necessary deadlines. Many courts and government agencies have reduced or closed their operations, and as a result scheduled matters are being postponed and rescheduled as appropriate. We have no control over some of these changes, and ask for everyone’s patience and understanding in this respect. We will continue to monitor and update you on any changes.
Pending Matters:
If you currently have a pending matter, our attorneys and staff are continuing to work on your matter. If you have any questions regarding your matter, feel free to call or email the attorney or support staff member responsible for your matter.
New Matters:
In order to comply with all applicable orders and recommendations from local, state and federal authorities, we are scheduling all new matters, whenever possible, via telephone and/or video conferencing. Please reach out to any of the attorneys or staff members with whom you have worked on any matters in the past, and they will gladly assist, or direct you as appropriate. Recommendations:
Given these unsettled times, there are some important considerations and legal decisions that we urge our clients to review. We are providing some highlights of the areas of concern and recommend to our clients that they undertake a review of these, as well as other legal matters to determine if any changes are necessary or appropriate, or if their personal or business needs can benefit from such changes. Estate Planning, Designation of Health Care Representatives and Powers of Attorney:
Clients should periodically review, and if necessary update their wills, designation of health care representatives and powers of attorney. If you do not have estate planning documents, or if those documents are outdated due to their age or change in circumstances, we strongly urge you to prepare or update those documents as appropriate.
Real Estate Matters:
As the dust settles, and we resume our normal lives, those intending to sell their home, or purchase a new one, will be in competition to rush back into the market that has come to an abrupt stop. Advance planning while the “stay at home” orders are in place will give you a head start once we’re back to normal. Also, those of you who may have purchased or refinanced in the last 5-10 years may see a financial benefit by refinancing any existing mortgage debt. There may also be opportunities for those who can close quickly to purchase property, especially if using cash or private financing.
Business Matters:
Our business clients, like many others throughout the state and country have seen tremendous declines in revenue as a result of the closure orders. The economic engine that was roaring a short time ago has come to a near complete stop. There is, however, light at the end of the tunnel. The recently enacted CARES Act will, among other things, help small businesses in a number of significant respects. The Act will provide capital to cover the cost of retaining employees through the Paycheck Protection Program; can provide an immediate infusion of cash through the Emergency Economic Injury Grant; and can provide funding to assist with payments on any current or potential SBA loans through the Small Business Debt Relief Program.
Employment, Workers Compensation & Unemployment:
Unemployment benefits have been expanded, and if there is exposure to COVID-19 while in the course and scope of your employment, the subsequent illness and wage loss can be covered by the employer’s workers compensation insurer.
